FindItemsByProduct (EAN) Fails

I've been using FindItemsByProduct successfully across Blu-Ray's , DVD's and MUSIC using the EAN and my script's happily processed over 2000 db records with lovely eBay data but I have an extremely large number of calls all returning errorid 41 and I am at a complete loss as if I visit eBay and search using the EAN, results do show. This is the case for many, many barcodes.
